2. Implementation of the conditions of sale

The Customer who makes a purchase in BeRacing1 accepts these conditions of sale in their entirety. They can access our services, promotions and make purchases all those individuals who are of legal age, with sufficient capacity to contract. The data with which the Customer registers must be truthful and complete. BeRacing1 reserves the right to not admit or to cancel the registration of those Customers who do not comply with these requirements.

3. Products and/or services

BeRacing1 tries to ensure that the products are shown and described as accurately as possible. It may happen that the packaging of the item you receive does not match the packaging shown on the product sheet. As there may be production runs that present different packaging, BeRacing1 does not undertake to specifically serve the one photographed. Minor colour and other variations in products may occur due to image scanning, display technologies or other technical reasons. BeRacing1 will not be held responsible for these variations and deviations. If there is an error or omission in the presentation and it is not attributable to the responsibility and/or will of BeRacing1, BeRacing1 may decline any claim. BeRacing1 reserves the right to decide at any time, the products and services offered to users through the portal.

Likewise, BeRacing1 reserves the right to stop providing access, at any time and without prior notice, to any of the products and/or services displayed on the portal.

4. Prices

The prices of all products offered in our BeRacing1 online shop are always in euros and include VAT and other applicable taxes (WEEE). The prices are only valid in our online shop, not necessarily being the same in our physical shops. The prices of the articles may vary at any time and without prior notice to the customer (changes in supplier rates, offers or any other). In the event of any kind of serious error (problems with prices in the database, etc.) in relation to prices, the customer will be duly informed of this circumstance and will be offered the option of continuing with the order or cancelling it. If there is any error in any of the prices, stock or products shown and any user will make the purchase decision based on this error, BeRacing1 will inform the customer situation and, in case of not reaching an agreement, reserves the right to cancel the order and refund the amount.

Discounts applied by means of a code or coupon will only be valid if the purchase is made within the promotional period. In case of purchase after the deadline, the customer must pay the difference in order to receive the products, otherwise the order will be cancelled and the amount refunded in full.

7. Reservations

In case you have the possibility to reserve on BeRacing1 you can reserve those items that are not yet available. You have to purchase the item in the usual way and take into account the date of availability. The order will be shipped only when the reserved item is available. If the order contains both in-stock and reserved items, it will only be shipped when all items are available. You will be able to identify an item that can be reserved because a message will appear on the product sheet informing you of this possibility. The return period for orders containing reserved items will start from the day the order is received.

8. Sending

At Bob Exhausts Racing we send our packages by MRW or Nacex, with the following shipping costs depending on the amount of the purchase:

• Orders up to 59€ with shipping to Peninsula, 6€ shipping costs (Mensajeria 24-48H).
• Orders up to 199€ with shipping to Balearic Islands, 20€ shipping costs (Courier 48-72H).
• Orders up to 59€ with shipping to Portugal, 8€ shipping costs (Courier 24-48H).
• Orders up to 999€ with shipping to the Canary Islands, Ceuta or Melilla, 25€ shipping costs by Correos.
• Orders from 59€ Peninsula, free shipping (Courier 24-48H).
• Orders from 199€ Balearic Islands, free shipping (Courier 48-72H).
• Orders from 59€ with shipping to Portugal, free shipping (Mensjería 24-48H).

9. Guarantee

Goods of a durable nature are guaranteed for 3 years from the date of delivery for products purchased from 2022 onwards. This does not include deficiencies caused by negligence, knocks, improper use or manipulation, unsuitable voltage, incorrect installation not carried out by the authorised Technical Service where applicable, or materials subject to wear and tear due to normal use. In those incidents that justify the use of the guarantee, the repair, replacement of the article, discount or refund will be chosen in accordance with the legally established terms.

10. Returns and right of withdrawal

In accordance with the current regulations agreed in the Royal Legislative Decree 1/2007, of 16 November, the Customer has a period of 14 calendar days to exercise their right of withdrawal from the purchase made through the website https://www.beracing1.com/gb/. The period shall be calculated from receipt of the product purchased or from the conclusion of the contract if it is the provision of services, except in cases where the product has been tampered with or damaged and is not delivered in the conditions stipulated for this purpose. To do so, you should contact the Customer Service Department by sending an e-mail to the following address[email protected] commenting on their situation.

BeRacing1 will make the payment of the order by the same way the purchase was made, in a period never exceeding 14 calendar days, provided that the product is in perfect condition, with all its components, accessories, manuals and original packaging.

The refund will include the amount of the purchase and the possible delivery costs that the Client has paid in the purchase process. However, if the Client has selected a different delivery method to the one offered in the ordinary way for the delivery of the product, BeRacing1 will not reimburse the additional costs arising therefrom.

The Customer shall bear the cost of returning the product, in accordance with the provisions of article 108 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

The reimbursement shall be made within 14 calendar days from the date on which we have been informed of the Customer's decision to withdraw from the contract. We may withhold reimbursement until we have received the goods.

The Customer must return the product within 14 days of delivery, in perfect condition, with all its components, accessories, manuals and in its original packaging.

The Customer shall be liable for any diminished value of the product returned with damage or handling other than the nature of the product or its agreed use.

All merchandise must be returned in its original packaging and conditions, in perfect condition and protected, avoiding stickers, seals or adhesive tapes directly on the surface or packaging of the article. Otherwise BeRacing1 reserves the right to refuse the return.

Return of products with gift or promotion. The complete return (complete pack or article + gift) will be obligatory in order to be able to proceed with the refund. In the case of products that include game download codes, it will be a requirement not to have downloaded them in order to proceed with the full refund. In the event that it has been downloaded, the amount of the game will be deducted from the total amount to be refunded.

Under no circumstances will it be possible to return unsealed products that can be reproduced or copied immediately, as well as products intended for personal hygiene or which, due to their nature, cannot be returned.

11. Responsibility

BeRacing1 undertakes to deliver your order as soon as possible to the selected transport company. However, BeRacing1 will not be responsible for: damages resulting from a bad transport, especially for reasons such as industrial actions, traffic congestion and in general any other typical reason of the sector that result in delays, losses or theft of the chosen product. Nor for technical failures which, due to accidental causes or any other type, may prevent the normal operation of the service via the Internet. Nor for the lack of availability of the site for maintenance reasons or any other reason that prevents the user from accessing the service.

BeRacing1 will use all available means to provide the selection process, payment and shipping of the desired product. BeRacing1 declines any responsibility for third party causes, fortuitous circumstances and force majeure situations.
